ADATA-SHARIAH GOVERNANCE IN DAGESTAN

The article discusses issues related to adata-Sharia running in Dagestan. For a long time about three hundred years), the peoples of Dagestan there were mixed legislation, is composed of two main parts: Sharia and ADAT. If the basis of the Shari´a were the General rules of morality and Muslim religions-Islam, ADAT(Arabic for “ADAT” tradition, tradition”) were based on practices that are primarily defended strong and then weak. The history of origin of ADAT and especially his relationship with Sharia law and Russian law has yet to be fully investigated. Most of the sources are not introduced into scientific circulation. A deep study of the history of Dagestani society, system of moral-legal relations between ADAT, which contains produced for centuries by the peoples moral and legal norms with religious law - Sharia and the laws of Russia allows to reveal a powerful spring harmonization of socio-political and legal spheres of life, a combination of national characteristics and national interests achieved in a single Russian society. And whatever argued by some scholars about the colonial nature of the Russian conquest of Dagestan, the creation of a ruthless system of colonial domination in it, for anybody not a secret the fact that Russia not only did not abolish customary law (ADAT), which regulate all legal and moral norms of the life of the highlanders, not only took no measures against Sharia, but, moreover, she supported them and along with them were gradually introduced its own laws, which had to comply with every Daghestani, as a citizen of Russia.
