ON QUESTION OF ESTABLISHING THE LEGAL MEANING OF THE INSTITUTION OF «THE TERRITORIAL BASIS OF LOCAL-SELF GOVERNMENT»

The author considers the problem on the establishment of the legal meaning of the institute of the territorial basis of local self-government. Based on the analysis of the practice of normative fixing this definition in the federal legislation, the legislation of the Russian Federation, the decisions of the higher courts, as well as scientific publications prominent domestic legal scholars, the author concludes that the actual presence in the scientific community of the two major trends in the definition of the territorial basis of local self-government. The first of them, is defined as the territorial basis of local government municipality, is very reasonable. The second, relating to the territorial basis of local self-government body of law, subject to the author of the criticism. The author suggests that the role of the municipality, as a real territorial basis of local government - is the role of the material base, a key element without which the local government as a legal institution is meaningless.
