LEGAL ASPECTS OF INVIOLABILITY OF THE HOME IN AN EMERGENCY SITUATION TO ENSURE A SUSTAINABLE ECO-BALANCE RIGHTS

Considering the provisions of the various laws and regulations and scientific views on the right to inviolability of the home, it was concluded: constitutional human right to privacy of the home is part of a fairly capacious right to privacy and is not limited to the prohibition of unlawful entry into a dwelling, and provided by a system of law establishing addressed to both citizens and officials of the prohibition to act (or omission) that violate the rights of others, and to mean unlawful, arbitrary, unlawful violation of the right to inviolability of the home, the responsibility for their violation. It also concluded that at the present time in the Russian Federation is not in the federal laws regulatory consolidation conditions of the limited right to inviolability of the home in an emergency, as required by the Constitution.
